Terms and Conditions for the ePost Service

These Terms and Conditions ("Terms") govern the use of the ePost Service provided by Post Aruba N.V. ("Post Aruba"). The ePost Service enables Customers to purchase goods from online retailers using a designated United States Shipping Address and to have those goods transported to Aruba for customs clearance, collection or delivery.
By registering for, accessing or using the ePost Service, the Customer acknowledges that he or she has read, understood and agrees to be bound by these Terms and Conditions, as amended from time to time.
For the purposes of these Terms and Conditions, the following definitions apply:

| United States Shipping Address | the designated delivery address assigned by Post Aruba for use by Customers when purchasing goods from online merchants. |
2.1 How the ePost Service works. The ePost Service enables Customers to purchase goods from online merchants and have those goods delivered to the United States Shipping Address assigned by Post Aruba for onward transportation to Aruba.
2.2 Service description. The ePost Service enables Customers to purchase goods from online merchants, have those goods delivered to a designated United States Shipping Address assigned by Post Aruba, request consolidation of eligible shipments, and arrange for transportation to Aruba, subject to these Terms and Conditions.
2.3 Consolidation of shipments. As part of the ePost Service, Customers may request the consolidation of multiple eligible shipments received at the Customer's assigned United States Shipping Address into a single shipment for transportation to Aruba. A consolidated shipment may contain a maximum of three (3) packages. Consolidation is subject to operational feasibility, the availability of all shipments for consolidation, applicable customs requirements, carrier restrictions and any other operational or legal requirements, and Post Aruba reserves the right to determine whether shipments are eligible and suitable for consolidation. Pieces larger than 28" x 39.5" are treated as loose pieces and cannot be consolidated. Consolidation is subject to a handling fee of AWG 25,00, in addition to freight, insurance and import taxes.
2.4 Role of Post Aruba. Post Aruba acts solely as a logistics and package forwarding service provider. Post Aruba is not the seller, supplier, manufacturer or owner of the goods purchased by the Customer.
2.5 Purchasing goods online. The purchase contract for goods ordered through an online merchant exists solely between the Customer and the Merchant. See Article 5 (Purchasing Goods Through ePost), in particular Article 5.8 (Merchant Transactions), for the scope of Post Aruba's responsibility in relation to such purchases.
2.6 Applicable laws and regulations. The ePost Service is subject to applicable laws, customs regulations, aviation security requirements, these Terms and Conditions and the published Tariff of Post Aruba.
3.1 Eligibility. The ePost Service is available to individuals who are at least eighteen (18) years of age and to legal entities capable of entering into legally binding agreements. By registering for an ePost Account, the Customer represents and warrants that all information provided during registration is complete, accurate and up to date.
3.2 Registration. To use the ePost Service, the Customer must complete the registration process prescribed by Post Aruba and provide the information and supporting documentation reasonably required to establish and maintain an ePost Account.
3.3 Verification. Post Aruba reserves the right to verify the identity of the Customer at any time and may require the Customer to provide valid identification, proof of address or any other documentation considered necessary to comply with applicable laws, regulatory requirements or internal security procedures.
3.4 Approval of registration. Registration for the ePost Service becomes effective only upon approval by Post Aruba. Post Aruba reserves the right to refuse, suspend or terminate any application or account where the information provided is incomplete, inaccurate, misleading or where the use of the ePost Service would be contrary to applicable law or these Terms and Conditions.
3.5 Customer account. Upon successful registration, the Customer is assigned an ePost Account together with a unique United States Shipping Address and Suite Number for use in connection with the ePost Service.
3.6 Account security. The Customer is responsible for maintaining the confidentiality of his or her account credentials and for all activities carried out through the ePost Account. The Customer shall notify Post Aruba immediately if the account credentials have been lost, compromised or used without authorization.
3.7 Changes to customer information. The Customer shall promptly notify Post Aruba of any changes to his or her name, address, telephone number, email address or other information relevant to the operation of the ePost Account. Post Aruba is not responsible for delays or losses resulting from the Customer's failure to keep such information current.
3.8 Electronic communication. The Customer agrees that Post Aruba may communicate with the Customer electronically, including by email, WhatsApp or other electronic means, for the purpose of providing notifications relating to shipments, invoices, customs requirements, account administration or other matters connected with the ePost Service.
4.1 Assignment. Upon successful registration, Post Aruba assigns the Customer a designated United States Shipping Address together with a unique Suite Number for use exclusively in connection with the ePost Service.
4.2 Correct use. The Customer shall ensure that the complete and correct United States Shipping Address, including the assigned Suite Number, is provided to the online merchant at the time of purchase. Post Aruba is not liable for delays, misrouting, additional charges or loss resulting from an incorrect, incomplete or omitted Suite Number or shipping address.
4.3 Ownership. The United States Shipping Address and Suite Number remain the exclusive property of Post Aruba and are provided solely for the purpose of receiving shipments through the ePost Service.
4.4 Unauthorized use. The Customer shall not sell, transfer, assign, lend or permit any unauthorized person to use the assigned Suite Number or ePost Account without the prior written consent of Post Aruba.
4.5 Changes by Post Aruba. Post Aruba reserves the right to modify, replace or withdraw a Customer's assigned Suite Number or United States Shipping Address where operational, security or administrative reasons require such action.
4.6 Unidentified packages. Packages received without sufficient information to identify the Customer, including the absence of a Suite Number, may be delayed while Post Aruba attempts to identify the intended recipient. Where identification cannot reasonably be established, Post Aruba may return the package to the sender, hold it pending further instructions, or otherwise dispose of it in accordance with these Terms and Conditions and applicable law.
5.1 Choosing an online merchant. The Customer may purchase goods from any online merchant that accepts delivery to the United States Shipping Address assigned by Post Aruba. The Customer is solely responsible for selecting the online merchant and for determining whether the merchant is reputable, reliable and suitable for the Customer's needs.
5.2 Availability of goods. Post Aruba does not guarantee the availability of any goods offered by an online Merchant and is not responsible where a Merchant refuses, cancels or is unable to complete an order. See Article 5.8 (Merchant Transactions) regarding the scope of Post Aruba's responsibility for Merchant transactions generally.
5.3 Providing the correct shipping address. See Article 4.2 (Correct Use) regarding the Customer's obligation to provide the correct United States Shipping Address and Suite Number to the Merchant, and the consequences of failing to do so.
5.4 Order documentation. The Customer shall retain and, upon request, provide copies of all purchase confirmations, invoices, receipts and any other documentation relating to the purchase of goods through the ePost Service. Post Aruba may require the Customer to provide such documentation for customs clearance, valuation, verification or claims processing.
5.5 Invoice and proof of purchase. The Customer shall provide a clear, authentic, complete and valid invoice or other satisfactory proof of purchase for each shipment through the procedures established by Post Aruba and in accordance with the requirements of the competent customs authorities. The invoice or proof of purchase shall accurately identify the goods purchased, the purchase price and any other information required for customs clearance or reasonably required by Post Aruba to facilitate the processing of the shipment. Failure to provide the required documentation may result in delays in processing, customs clearance, delivery or release of the shipment. Post Aruba is not liable for any delay, additional charges or other consequences arising from the Customer's failure to provide the required documentation.
5.6 Package identification. Each shipment must be clearly identifiable by means of the assigned Suite Number or other identifying information prescribed by Post Aruba. Where a shipment cannot reasonably be matched to a Customer's ePost Account, Post Aruba may delay processing while attempting to establish ownership or may process the shipment only after ownership has been satisfactorily established in accordance with these Terms and Conditions.
5.7 Right to refuse processing. Post Aruba reserves the right to refuse to accept, suspend or delay the processing of any shipment where the required information, documentation or identification is incomplete, inaccurate, misleading or where processing the shipment would violate applicable laws, customs requirements or these Terms and Conditions.
5.8 Merchant transactions. The Customer acknowledges that all purchases are made directly from the online merchant and that Post Aruba is not a party to the purchase agreement. Accordingly, Post Aruba has no responsibility or liability for:
Any claim relating to the purchase of goods shall be addressed directly to the Merchant.
6.1 Accurate information. The Customer shall provide complete, accurate and up-to-date information when registering for the ePost Service and when using the Service. The Customer shall promptly notify Post Aruba of any changes to the information provided.
6.2 Compliance with laws. The Customer shall comply with all applicable laws, regulations and customs requirements relating to the purchase, importation, transportation and possession of goods through the ePost Service.
6.3 Customs documentation. The Customer shall promptly provide any invoice, proof of purchase, receipt or other documentation reasonably required by Post Aruba or the competent customs authorities to facilitate customs clearance and regulatory compliance.
6.4 Payment of charges. See Article 9 (Charges and Payment) regarding the Customer's obligation to pay all charges, duties, taxes and fees payable in connection with the ePost Service.
6.5 Prohibited and restricted goods. See Article 8 (Prohibited and Restricted Goods) regarding the goods the Customer may not purchase, ship or attempt to import through the ePost Service.
6.6 Cooperation. The Customer shall cooperate with Post Aruba by providing any information or documentation reasonably required to identify, process, transport, clear through customs or deliver a shipment.
6.7 Responsibility for account use. See Article 3.6 (Account Security) regarding the Customer's responsibility for activities carried out through the Customer's ePost Account and for maintaining the confidentiality of account credentials.
7.1 Customs clearance. All shipments imported through the ePost Service are subject to inspection, clearance and release by the competent customs authorities in Aruba.
7.2 Customs declarations. The Customer warrants that all invoices, declarations and supporting documentation submitted in connection with a shipment are complete, accurate and truthful.
7.3 Customs, duties and taxes. See Article 9 (Charges and Payment) regarding the Customer's responsibility for the payment of customs duties, import taxes, fees and other charges assessed by the competent authorities.
7.4 Customs delays. See Article 11.2 (Events Beyond Post Aruba's Control) regarding Post Aruba's liability for delay resulting from customs inspections, customs clearance procedures, seizure, detention or any action taken by the competent authorities.
7.5 Additional information. Post Aruba may require the Customer to provide additional information or documentation where necessary to comply with customs requirements or other applicable laws.
8.1 General prohibition. The Customer shall not use the ePost Service to purchase, transport or import goods that are prohibited or restricted under the laws of Aruba, the United States or any country through which the shipment is transported.
8.2 Examples of prohibited or restricted goods. Without limitation, prohibited or restricted goods may include:
8.3 Inspection. Post Aruba reserves the right to refuse acceptance or processing of any shipment that is reasonably suspected of containing prohibited or restricted goods.
8.4 Action by Post Aruba. Where prohibited or restricted goods are discovered, Post Aruba may refuse the shipment, suspend processing, notify the competent authorities or take any action required by applicable law.
8.5 Non-shipment of refused goods. Where a shipment is refused, seized, held or not released by the competent customs authorities or by Post Aruba pursuant to this Article, such shipment is not transported to Aruba. See Article 10.6 (Returns) regarding the return of such a shipment to the Merchant or sender.
9.1 Applicable charges. The Customer shall pay all charges applicable to the ePost Service in accordance with the published Tariff in force at the time the shipment is processed. The current shipping rates are shown on the ePost page.
9.2 Additional charges. The Customer is responsible for any additional charges arising from customs duties, taxes, storage charges, administrative charges or other costs incurred in connection with the shipment.
9.3 Payment before release. Post Aruba may require payment of all applicable charges before releasing a shipment to the Customer.
9.4 Failure to pay. Where the Customer fails to pay any amount due, Post Aruba may withhold delivery of the shipment until all outstanding amounts have been paid.
9.5 Tariff amendments. Post Aruba may amend its published Tariff from time to time. The applicable Tariff is the Tariff in force on the date the shipment is processed, unless otherwise determined by Post Aruba.
9.6 Insurance. All shipments processed through the ePost Service are covered by insurance against loss of or damage to the goods during transportation, up to the value of the Package subject to the maximum set out in Article 11.5 (Maximum Liability). The cost of this insurance is included in the Charges payable by the Customer in accordance with the published Tariff. Coverage under this Article is subject to Article 12 (Claims) and to the goods having been adequately and appropriately packaged for transportation. Post Aruba is not liable, and no claim is payable, for loss or damage caused wholly or partly by insufficient, inadequate or improper packaging of the goods. Compensation for an accepted claim is determined in accordance with Article 12.6 (Settlement of Claims) and Article 11.5 (Maximum Liability).
9.7 Storage charges. Storage charges begin to accrue on a Package or Shipment that remains uncollected: (a) at Post Aruba's warehouse facility in Miami, Florida, for a period exceeding thirty (30) days from the date of receipt; or (b) at Post Aruba's offices in Aruba, for a period exceeding thirty (30) days from the date the Shipment becomes available for collection or delivery. Storage charges are calculated in accordance with the published Tariff, without prejudice to Post Aruba's rights under Article 4.6 and Article 10.5 regarding unidentified or undeliverable shipments.
10.1 Transportation of shipments. Post Aruba arranges for the transportation of shipments received through the ePost Service from the United States to Aruba using transportation providers selected by Post Aruba.
10.2 Estimated delivery times. Any delivery or transit times communicated by Post Aruba are estimates only and do not constitute a guarantee of delivery within a specified period.
10.3 Delays. See Article 11.2 (Events Beyond Post Aruba's Control) regarding Post Aruba's liability for delays caused by customs inspections, aviation security measures, weather conditions, carrier delays, public authorities, force majeure or other circumstances beyond its reasonable control.
10.4 Delivery and collection. Shipments are made available for collection or delivered in accordance with the delivery option selected by the Customer and the operational procedures established by Post Aruba.
10.5 Undeliverable shipments. Where a shipment cannot reasonably be delivered or collected, Post Aruba may, after giving prior notice to the Customer where contact details are available, store, return, dispose of or otherwise deal with the shipment in accordance with these Terms and Conditions and applicable law.
10.6 Returns. Where a Customer requests that a shipment, including a shipment refused or withheld under Article 8 (Prohibited and Restricted Goods), be returned to the Merchant, sender or other party, all costs associated with the return, including return shipping, handling, customs charges and any other applicable fees, are borne solely by the Customer.
11.1 Limitation of liability. Except where otherwise required by applicable law, and except in cases of intent or gross negligence on the part of Post Aruba, the liability of Post Aruba is limited to the remedies expressly provided under these Terms and Conditions.
11.2 Events beyond Post Aruba's control. Post Aruba is not liable for any loss, damage or delay resulting from circumstances beyond its reasonable control, including force majeure, acts of government, customs actions, strikes, civil disturbances, natural disasters, aviation disruptions or failures of third-party carriers.
11.3 No liability for merchant performance. See Article 5.8 (Merchant Transactions) regarding the scope of Post Aruba's liability, or lack thereof, in relation to any act or omission of an online Merchant.
11.4 Consequential loss. Except in cases of intent or gross negligence, Post Aruba is not liable for indirect, incidental, consequential or economic loss, including loss of profit, business interruption or loss of opportunity.
11.5 Maximum liability. Where Post Aruba is liable, compensation shall not exceed the actual proven value of the Package, subject to a maximum of United States Dollars two hundred (US $200.00) per Package, or any other applicable liability limit established by law, the applicable Tariff or these Terms and Conditions, whichever is lower. See also Article 9.6 (Insurance) and Article 12 (Claims).
12.1 Submission of claims. Claims can be submitted using the contact form on our Help & Support page, which prepares an email to customerservice@postaruba.com, or using the claim form in your Post Aruba client portal. A claim relating to loss, damage or delay must be submitted within the time prescribed by applicable law or the procedures published by Post Aruba. See Article 12.2 (Claims for Damage) and Article 12.3 (Claims for Loss or Delay) for the specific timeframes applicable to those claim types.
12.2 Claims for damage. Damage to a Package should be reported to Post Aruba immediately upon delivery or collection of the shipment, where reasonably possible. A claim for damage reported after the Customer has taken possession of the shipment may be rejected where Post Aruba cannot establish that the damage occurred during transportation. Claims for damage are subject to the goods having been adequately and appropriately packaged for transportation; see Article 9.6 (Insurance).
12.3 Claims for loss or delay. A claim for loss or delay may be submitted where a shipment has not arrived, and the Customer has received no notification from Post Aruba of its arrival at the ePost warehouse, within seven (7) Business Days of the shipment's expected arrival.
12.4 Supporting documentation. The Customer shall provide all documentation reasonably required by Post Aruba to investigate the claim, including invoices, receipts, photographs, customs documentation and proof of value where applicable.
12.5 Investigation. Post Aruba investigates claims in accordance with its internal procedures and any applicable legal or international postal requirements.
12.6 Settlement of claims. Where a claim is accepted, compensation is limited to the actual invoiced or proven value of the lost or damaged goods, subject to the maximum liability amount set out in Article 11.5 (Maximum Liability), and does not include shipping charges, duties, taxes or any indirect or consequential loss (see Article 11.4).
12.7 Fraudulent claims. Where a claim is fraudulent or contains false or misleading information, Post Aruba may reject the claim and take any action permitted by law.
12.8 Complaints. If you are not satisfied with how a claim or other matter was handled, you may contact customer service at customerservice@postaruba.com.
13.1 Suspension of service. Post Aruba may suspend or restrict a Customer's access to the ePost Service where the Customer breaches these Terms and Conditions, fails to pay any amounts due, provides false information or otherwise misuses the Service.
13.2 Termination by the Customer. The Customer may terminate the ePost Service by closing the ePost Account, subject to payment of all outstanding charges and completion of any pending shipments.
13.3 Termination by Post Aruba. Post Aruba may terminate the Customer's ePost Account where continued use of the Service would violate applicable law, these Terms and Conditions or Post Aruba's operational requirements.
13.4 Outstanding obligations. Termination does not affect any rights, liabilities or obligations that arose before the date of termination.
Post Aruba processes personal data in accordance with applicable data protection legislation and our Privacy Policy. This Article describes the personal data processed for the ePost Service in particular.
14.1 What we collect. When you register for the ePost Service, we collect your name, date of birth, contact details, Aruba address and identification information. When you use the Service, we also collect package and shipment details, such as tracking numbers, Merchants, declared values and invoices you upload.
14.2 How we use it. We use your information to create and manage your Account, assign your United States Shipping Address, process and consolidate your Packages, communicate with you about deliveries and holds, and provide customer support.
14.3 Sharing with our warehouse partner. To receive and process your Packages in Miami, we share your registration and Package details with our cross-border logistics partner, who operates our United States warehouse. This partner uses this information only to fulfil the shipping and consolidation service, and not for its own marketing purposes.
14.4 Other disclosure. In addition to the sharing described in Article 14.3, Post Aruba may disclose Customer information where required by law or where reasonably necessary for customs clearance, transportation, delivery or regulatory compliance.
14.5 How long we keep it. We keep your Account and shipment records for as long as your Account is active, and for a reasonable period afterward to meet accounting and customs requirements.
14.6 Your choices. You can review and update most of your Account details from your Account page at any time. To request a copy of your data, or to ask us to delete your Account, contact our customer service team.
14.7 Contact. Questions about this Article or your data can be sent to customerservice@postaruba.com.
15.1 Amendments. Post Aruba reserves the right to amend these Terms and Conditions from time to time.
15.2 Publication. The amended Terms and Conditions become effective upon publication on the Post Aruba website or such later date as specified by Post Aruba, and apply to shipments processed after that date. Each version shows its effective date.
16.1 Governing law. These Terms and Conditions are governed by and construed in accordance with the laws of Aruba.
16.2 Jurisdiction. Any dispute arising from or relating to these Terms and Conditions shall be submitted exclusively to the competent courts of Aruba.
17.1 Entire agreement. These Terms and Conditions constitute the entire agreement between Post Aruba and the Customer regarding the ePost Service.
17.2 Severability. If any provision of these Terms and Conditions is held to be invalid or unenforceable, the remaining provisions remain in full force and effect.
17.3 Waiver. Failure by Post Aruba to enforce any provision of these Terms and Conditions does not constitute a waiver of its rights.
