Mail and Parcel Services

1. Definitions

TermMeaning
Air CarrierThe airline or other carrier responsible for transporting postal items by air.
Applicable LawThe laws and regulations of Aruba, including the Postal Ordinance, the Postbesluit and any other legislation applicable to the provision of postal services, together with applicable international postal agreements where relevant.
Authorized AgentA person authorized by the Sender or Recipient to send, collect or accept delivery of a postal item on their behalf.
Business DayAny day on which Post Aruba is open for normal business, excluding Saturdays, Sundays and officially recognized public holidays in Aruba.
Declared ValueThe value declared by the Sender at the time of posting for insurance or compensation purposes. The declared value represents the maximum amount for which compensation may be payable, subject to these Terms and Conditions. The declared value does not constitute proof of the actual value of the contents. In the event of a claim, the Sender must provide satisfactory evidence of the item's value, including receipts, invoices or other acceptable proof of purchase or ownership.
Domestic MailPostal items accepted for delivery within Aruba.
Foreign Postal OperatorThe postal operator or postal administration in another country responsible for processing or delivering postal items outside Aruba.
International TransportThe movement of postal items between Aruba and another country.
Post ArubaPost Aruba N.V.
Postal ItemAny letter, parcel, packet, EMS item, registered item, insured item or other article accepted by Post Aruba for postal processing and delivery.
RecipientThe person or entity to whom a postal item is addressed.
SenderThe person or entity sending a postal item.
TariffThe schedule of rates, charges and fees published by Post Aruba, as amended from time to time.
UPUThe Universal Postal Union, including its Acts, Regulations and applicable international postal standards.

Part A – General Conditions (applicable to all services)

2. Acceptance of Items

2.1 Post Aruba accepts items subject to:

  • Compliance with these Terms and Conditions
  • Applicable Aruban law
  • Universal Postal Union (UPU) regulations (for international mail)
  • Aviation security regulations

2.2 Post Aruba reserves the right to:

  • Refuse prohibited or dangerous items
  • Delay processing for security or customs inspection
  • Refuse service to any sender or shipment for reasonable risk, compliance or operational reasons

2.3 Acceptance of an item by Post Aruba does not constitute confirmation that the item complies with these Terms and Conditions, applicable laws, customs requirements, Universal Postal Union (UPU) regulations, or the laws and regulations of the destination country. The Sender remains solely responsible for ensuring that the item and its contents comply with all applicable legal and regulatory requirements.

2.4 Acceptance of an item does not prevent Post Aruba from conducting additional inspections or taking any action required by law or these Terms and Conditions.

3. Prohibited & Restricted Items

3.1 The Sender is solely responsible for ensuring that items do not contain:

  • Dangerous goods (flammable, explosive, toxic materials)
  • Illegal substances
  • Perishable goods (unless specifically permitted)
  • Currency or valuables unless sent via approved insured service
  • Items prohibited by applicable law, Universal Postal Union (UPU) Regulations or the laws of the destination country

3.2 Post Aruba shall not be liable for:

  • Confiscation by customs authorities
  • Destruction of prohibited goods
  • Fines or penalties due to improper declaration

4. Addressing & Packaging

4.1 The Sender is responsible for:

  • Correct and complete addressing
  • Proper packaging that is sufficient to withstand normal postal processing, handling, storage, and transportation
  • Accurate customs declaration

The Sender must ensure that the recipient's name, address, postal code (where applicable), and contact information (where required) are complete and accurate in order to comply with proper delivery procedures.

4.2 Post Aruba is under no obligation to investigate, correct, complete or verify incomplete, incorrect, illegible or insufficient addresses provided by the Sender. Any resulting delay, mis-delivery, non-delivery or return of the item shall be at the Sender's risk.

4.3 Post Aruba is not liable for damage caused by inadequate packaging.

Part B – Outbound Mail (from Aruba to other countries)

5. Responsibility of Post Aruba (Outbound)

Post Aruba is responsible for:

  • Collection and processing within Aruba
  • Secure handling until transfer to the Air Carrier or foreign postal operator
  • Proper dispatch documentation

Responsibility of Post Aruba ends when:

  • The item is officially handed over to the Air Carrier for international transport; or
  • The item is delivered to the designated Foreign Postal Operator

6. Responsibility of the Air Carrier

6.1 Once mail is handed over to the Air Carrier, it will be responsible for the mail during air transport. Liability is governed by international aviation conventions (including the Montreal Convention, where applicable).

6.2 Post Aruba is not liable for:

  • Loss, delay, or damage occurring during air transport
  • Flight delays, cancellations, or disruptions

7. Responsibility of Foreign Postal Operators

7.1 Upon arrival in the destination country:

  • The Foreign Postal Operator assumes responsibility
  • Delivery is subject to that country's laws and postal regulations

7.2 Post Aruba is not responsible for:

  • Delays due to customs clearance
  • Delivery practices of the foreign postal operator
  • Seizure or destruction by foreign authorities

8. Liability for Loss or Damage (outbound and domestic)

Liability of Post Aruba shall be governed by applicable Aruban law and international postal agreements, including the Postbesluit and UPU regulations. In no event shall Post Aruba's liability exceed the limits established by applicable law, the Postbesluit or the Universal Postal Union Regulations, as applicable.

8.1 Ordinary Letter Mail. No compensation shall be payable for loss, delay, or damage to ordinary (non-registered) letter mail, unless otherwise required by applicable law.

8.2 Registered Mail. In accordance with the Postbesluit:

  • a. In the event of loss of a registered item, compensation shall be limited to AWG 75,00 per item, regardless of the actual value of the contents.
  • b. In the event of total theft or total damage to the contents, compensation shall also be limited to AWG 75,00, regardless of value.
  • c. No compensation shall be payable if:
    • The packaging was insufficient to reasonably protect the contents; and
    • The damage or theft was not established at the time of delivery in the presence of a postal employee

8.3 Parcels. In the event of loss or damage to a parcel:

  • Compensation shall be limited to a maximum of AWG 100,00; plus
  • AWG 10,00 per kilogram (or part thereof)
Please note

A parcel shall be deemed lost if it cannot be delivered within two (2) months after posting.

8.4 Conditions for Compensation. Compensation shall only be granted if:

  • A written claim is submitted within six (6) months after posting
  • The Sender provides proof of posting
  • The Sender cooperates and provides all requested information

No claim shall be accepted without proof of posting.

8.5 Loss of Contents. Compensation for partial loss of content(s) shall only be granted where:

  • The item shows visible damage at delivery; and
  • The contents are verified in the presence of a postal employee at the time of delivery

8.6 Termination of Liability. Liability of Post Aruba shall cease once:

  • The item has been delivered against receipt; or
  • The Recipient has accepted the item without noting damage

For parcels, applicable provisions of the Civil and Commercial Code of Aruba shall apply.

8.7 Recovery of Lost Items. If a lost item is subsequently recovered:

  • The Sender shall be notified and may reclaim the item within 30 days, upon repayment of any compensation received
  • If the Sender does not act within this period, the Recipient shall be given the same opportunity

If neither party claims the item, ownership shall transfer to Post Aruba N.V.

Part C – Inbound Mail (from other countries to Aruba)

9. Responsibility of Foreign Postal Operators (Inbound)

9.1 Before arrival in Aruba:

  • The originating postal operator is responsible
  • Transport liability rests with the Air Carrier during air transport

Post Aruba assumes responsibility only after official receipt of the item in Aruba.

10. Responsibility of Post Aruba (Inbound)

After receiving mail in Aruba, Post Aruba is responsible:

  • For processing through local postal facilities
  • Coordination with customs authorities
  • Final delivery within Aruba

Post Aruba is not responsible for:

  • Delays caused by customs inspections
  • Incomplete customs documentation
  • Duties or taxes imposed by customs authorities

11. Customs Requirements

11.1 All inbound items are subject to customs control.

11.2 The Sender is responsible for ensuring that all customs declarations and supporting documentation required for international postal items are completed accurately, truthfully and in full.

11.3 The Sender warrants that all information provided in customs declarations and any accompanying documentation is complete, accurate and truthful. The Sender shall be responsible for any loss, delay, return, seizure, fines, penalties or additional costs arising from inaccurate, incomplete or false customs declarations.

11.4 Post Aruba may require the Sender or Recipient to provide invoices, proof of value, export permits or any other documentation reasonably required to comply with customs or other regulatory requirements.

11.5 Post Aruba shall not be liable for delays, inspections, detention, seizure or refusal of entry by customs or other competent authorities resulting from the contents of the item or the information provided by the Sender.

11.6 The Recipient is responsible for:

  • Payment of customs duties
  • Payment of import taxes
  • Payment of handling fees
  • Providing required documentation, invoices, etc.

Post Aruba acts only as an intermediary and is not liable for customs decisions, cannot guarantee customs clearance or release of any postal item. Post Aruba has no authority over Customs processing times and cannot guarantee release dates.

Part D – Delivery Conditions

12. Delivery

12.1 Delivery is deemed completed when:

  • The item is delivered to the address provided; or
  • Delivered to an authorized agent; or
  • Collected from a Post Aruba facility

12.2 The Recipient should examine the item upon delivery. Any visible damage or shortage should be reported immediately to Post Aruba before full acceptance, where reasonably possible.

12.3 Post Aruba may require identification upon delivery. Where a signature service has been purchased, the recorded delivery scan or electronic signature maintained by Post Aruba shall constitute prima facie (at first sight) evidence of delivery.

12.4 Delivery standards and transit times published by Post Aruba are estimates only and do not constitute guaranteed delivery unless expressly stated otherwise for a specific service.

12.5 Delivery to an authorized household member, agent or representative constitutes valid delivery.

12.6 Post Aruba may retain items until all applicable postage, customs duties, storage charges and other fees have been paid. Post Aruba is not responsible for delays resulting from:

  • Incomplete addresses
  • Illegible addresses
  • Missing apartment numbers
  • Incorrect recipient names

12.7 Tracking Information. Tracking information is provided for the convenience of the Sender and Recipient only. Although Post Aruba uses reasonable efforts to ensure the accuracy of tracking information, such information is based on operational scanning events and may be delayed, incomplete or subject to correction. Tracking information is provided for informational purposes only and shall not constitute a guarantee of delivery or conclusive evidence of the location or status of an item. The recorded delivery scan or electronic signature referred to in clause 12.3 remains prima facie evidence of delivery.

13. Undeliverable Items

13.1 Circumstances Giving Rise to Undeliverable Items. An item may be deemed undeliverable where:

  • The address is incomplete, incorrect or illegible;
  • The Recipient refuses to accept delivery;
  • Delivery cannot be completed after reasonable attempts;
  • The item cannot be released due to customs requirements or the failure to provide required documentation or pay applicable duties or taxes; or
  • Delivery cannot be completed for any other lawful or operational reason
Storage deadline

13.2 Storage of Undeliverable Items. Undeliverable items awaiting collection shall be held by Post Aruba free of charge for a period of 15 calendar days from the date of arrival or notification, whichever occurs first. After the initial fifteen (15) day period, storage charges ("bewaarloon") shall accrue in accordance with the tariffs published by Post Aruba. All applicable storage charges must be paid prior or at the time of release of the item.

13.3 Return of Unclaimed Items. Unless otherwise required by law or applicable international postal regulations, any undeliverable item that remains unclaimed for a period of two (2) months from the date of arrival or notification may be returned to the Sender. The Sender shall be responsible for all applicable return postage, storage charges, customs charges and any other fees incurred in connection with the return of the item.

13.4 Disposal of Undeliverable Items. Where an undeliverable item cannot reasonably be returned to the Sender, or where return is prohibited by law, customs requirements or international postal regulations, Post Aruba may, after giving prior notice to the Sender or Recipient where contact details are available, dispose of the item in accordance with applicable law and the relevant postal regulations.

Part E – Force Majeure

14. Force Majeure

Post Aruba shall not be liable for delays or loss caused by:

  • Natural disasters
  • Pandemics
  • War or civil unrest
  • Airport closures
  • Airline disruptions
  • Government actions
  • Strikes
  • Customs interventions

Part F – Claims Procedure

15. Filing Claims

Submission of a claim does not constitute an admission of liability by Post Aruba.

How to file a claim

Claims can be submitted using the contact form on our Help & Support page, which prepares an email to customerservice@postaruba.com, or using the claim form in your Post Aruba client portal.

15.1 Claims must be submitted:

  • Within six (6) months after posting, for both domestic and international items, unless a different period is required by UPU rules or applicable law

15.2 Required documents:

  • Original receipt
  • Tracking number
  • For items with a declared value (insured items), the Sender must provide satisfactory evidence of the actual value of the contents. A declared value alone shall not be sufficient to establish entitlement to compensation

Compensation, if applicable, shall follow UPU standards and Aruban law.

15.3 Claims That May Be Denied. Post Aruba reserves the right to deny any claim, in whole or in part, where:

  • a. The item was inadequately packaged or insufficiently protected for normal postal handling or transportation.
  • b. The item contained prohibited or restricted goods in violation of these Terms and Conditions or applicable law.
  • c. The claim is fraudulent, misleading, or supported by false or altered documentation.
  • d. The claim is submitted after the applicable claim period has expired.
  • e. The Sender or Recipient fails to provide the required proof of posting, proof of value, or any other information reasonably requested by Post Aruba.
  • f. The loss or damage resulted from circumstances for which Post Aruba is not liable under these Terms and Conditions.

15.4 Complaints. If you are not satisfied with how a claim or other matter was handled, you may contact customer service at customerservice@postaruba.com.

Part G – Limitation of Liability

16. Limitation

To the fullest extent permitted by applicable law, and except in cases of intent or gross negligence on the part of Post Aruba, Post Aruba's liability is strictly limited to:

  • Amounts specified under UPU regulations
  • The declared value for insured items
  • Direct loss only

Post Aruba is not liable for:

  • Indirect damages
  • Consequential damages
  • Loss of business opportunity
  • Emotional distress

Part H – Privacy

17. Privacy

17.1 Post Aruba collects, uses and processes personal data only to the extent necessary for the acceptance, processing, transportation, delivery and administration of postal items, the handling of claims, and compliance with applicable legal and regulatory obligations.

17.2 Personal data shall be processed in accordance with the applicable privacy and data protection laws of Aruba. Further information is set out in our Privacy Policy.

17.3 Where necessary for the performance of postal services, Post Aruba may share relevant information with customs authorities, air carriers, foreign postal operators, government authorities or other service providers involved in the processing or delivery of postal items, in accordance with applicable law.

Part I – Governing Law

18. Governing Law & Jurisdiction

These Terms & Conditions are governed by the laws of Aruba. Any disputes shall be submitted exclusively to the competent courts of Aruba.

19. Severability

If any provision of these Terms is held invalid, the remaining provisions remain in effect.

20. No Waiver

Failure by Post Aruba to enforce any provision shall not constitute a waiver.

21. Changes to Terms

Post Aruba may amend these Terms, services and tariffs from time to time, as deemed necessary. The version published on this page on the date an item is posted shall apply to that item, and each version shows its effective date. These Terms and Conditions constitute the entire agreement governing the provision of postal services by Post Aruba unless otherwise required by applicable law.
